Aviva’s chief executive, David McMillan, has said that a legal requirement should be placed on injured people to contact ‘at fault’ insurers after an accident, so that they may deal with a claim directly.
Just what planet is this man living on? Essentially, what he is suggesting is that people should be discouraged from seeking independent legal advice so that unscrupulous insurers can take advantage of them. Mr McMillan has clearly never heard of conflict of interest!
At BLB Solicitors we are regularly contacted by people who have been duped by insurers into not having representation. A recent example involved a man who suffered serious injuries in a road traffic accident. The insurance company were putting pressure on him to accept £5,000 in settlement. Fortunately we have been able to get his claim back on track. Whilst his claim has yet to settle we have already recovered over £10,000 for him in interim payments and the final settlement is likely to be much higher.
