Damages for pain, suffering and loss of amenity

As for other types of injury and medical conditions, judges have fixed the range of compensation available for the ‘pain, suffering and loss of amenity’ caused by your CRPS. The latest edition of the Judicial College Guidelines suggests a range of damages for ‘Severe CRPS’ of £64,070 to £102,520.

However, it is important to remember that this applies only to the injury, and we also need to claim for your past and future financial losses. In fact, in most cases, future losses make up the largest part of your claim.

Although every claim is different, your claim will typically include:

Past Losses (also known as Special Damages)

It is virtually impossible to provide a comprehensive list of what can be included in your past losses. As a general rule, if the loss would not have occurred without the accident – and it is reasonable to claim it — then do so. The following are common types of past loss.

Loss of earnings

Your CRPS might mean that you are unable to work at all. Alternatively, you may have needed to reduce your hours or find a new job altogether. As part of your CRPS compensation claim, you are entitled to claim your net loss of earnings (i.e., your take-home pay, excluding income tax and National Insurance).

If you are self-employed or earn part of your income from bonuses or overtime, calculating your loss of earnings can be more complex. Often, with self-employed claimants, we instruct an expert forensic accountant to work with you and us to help calculate your past loss of earnings and estimate your future loss of earnings.

Loss of pension

In our experience, solicitors often overlook this. Legally, nearly all employers are required to contribute to your pension. If you are unable to work, you miss out on important pension contributions. These must be included in your CRPS compensation claim.

Treatment costs

It almost goes without saying that you should include in your CRPS compensation claim any treatment costs that have not already been paid by the other side. Usually, these cover the cost of physiotherapy, occupational therapy, cognitive behavioural therapy, nerve blocks, spinal cord stimulation/dorsal root ganglion stimulation, and residential pain management programmes.

Case management

In many cases, at the start of your CRPS compensation claim, we arrange for a case manager, who is an independent health professional, to advise and support you with issues such as home adaptations, specialist disability aids and equipment, and treatment.

The cost of the case manager should either be paid directly by the other party or included as part of your CRPS compensation claim.

The cost of care

Most people with CRPS require some form of assistance or support. This might include tasks such as housework, gardening, cooking, or assistance with activities like bathing, dressing, and personal care. Sometimes, you will pay for this help, but more often, it is provided by your family and friends.

Clearly, you are unlikely to have paid your partner or child to cook, clean, or look after you in any way. However, if these activities – or others you would have done yourself – would have contributed to your care had the accident not occurred, the law permits you to seek payment for them as part of your CRPS compensation claim.

Adaptations, aids and equipment

Typical adaptations include ramps and widened doorways to improve access, stairlifts, larger or more accessible baths and showers, and work surfaces at modified heights.

There are many aids and equipment for disability that make living with CRPS easier. Some are more affordable; others are very costly. Common ones we regularly claim for successfully include:

  • Smart Crutches;
  • Loopwheels for wheelchairs;
  • perching stools;
  • specialist beds and chairs;
  • grab rails;
  • disability scooters;
  • rough terrain scooters; and
  • driver-adaptations for cars.

Any of these items already purchased or recommended for the future should be included in your CRPS compensation claim.

Interest

Future Loss

Future losses are those you will face after your claim is settled. In nearly all cases, your future losses make up the largest part of your CRPS compensation claim.

In calculating future loss, the law tries to predict what is likely to happen in the future, compared to what would probably have occurred if you had not developed CRPS.

Your future losses are likely to include a continuation of your past losses plus several other types of loss, depending on your circumstances. Generally, the calculation will typically be the annual loss or cost of each item, projected forward to a specific point in the future. This might be the duration of your expected life expectancy or the nominal date of retirement, depending on the type of loss.

What do future losses include?

Typically, your CRPS compensation claim for future loss will include (but is not limited to):

  • Loss of earnings – including loss of chance of promotion and career progression;
  • Loss of pension;
  • The cost of future treatment;
  • The cost of care, including gardening, DIY and decorating;
  • Case management;
  • Adaptations, disability aids and equipment;
  • Child care;
  • Dog walking;
  • The extra costs of holidays – going away will no longer be as simple as it was before you developed CRPS. Your holiday options will be more limited, and the expenses are likely to be higher. You might need a larger hotel room to help you move around, assistance with luggage, a business class seat on your flight to gain extra elbow and leg room – the list goes on. These should be discussed with your solicitor and included in your claim.

How much CRPS compensation will you receive?

Regrettably, it is difficult to provide a definitive answer until all evidence is gathered. Nevertheless, due to the severe impact that CRPS has on every part of your life, total compensation amounts are generally high, often reaching into six or seven figures.

Compensation amounts for CRPS vary greatly between individuals. This is due to many reasons – no two people are identical. For instance, some may have responded better to treatment, require less assistance, or be able to continue working. All these factors influence the amount of compensation that can be recovered. Nonetheless, we work hard to secure the highest possible amount to protect you and your family financially in the long term.

CRPS compensation amounts: How long does the process take?

Most of our clients start their CRPS compensation claims with non-specialist law firms, typically large, factory-style firms that advertise in the media. Sadly, their lack of expertise, understanding, and overall poor standards not only harm your case but also cause delays in the settlement process.
